Now, after the bill gets a nod from the President, the ordinance will be coming into the effect.

Describing the practice of triple talaq as "barbaric and inhuman", Prasad said almost 22 countries have regulated triple talaq.

"I had met him five to six times.we had sought cooperation", he said adding that there was no response from the main opposition party.

Citing details of the ordinance, he said a woman or her blood relative will have to file a case before a police station to make the offence cognizable. Citing the lack of "consensus" in the House, Vice-President and Rajya Sabha Chairman Venkaiah Naidu, on the last day of the Monsoon session, deferred the Bill till the Winter Session .

Appealing to Congress to pass the bill in Rajya Sabha, Prasad said, "Despite Sonia Gandhi being at the helm of the Congress, the party is not letting the bill pass in Rajya Sabha because of vote bank politics". "It is a pure issue of gender justice, gender dignity and gender equality", said the law minister.

The Union Cabinet has given its approval to an ordinance on triple talaq even though a bill on the issue is pending in the Rajya Sabha.

"In a secular country like India. gender justice was given the complete go-by".

The Muslim Women (Protection of Rights on Marriage) Bill, 2017, which prohibits divorce by pronouncing instant talaq, or talaq-e-biddat, was passed in Lok Sabha in December 2017 with most of the leading parties in the opposition, including the Congress, voting in favour of the bill.

Further, in order to safeguard the rights of the woman against whom Triple Talaq has been pronounced, she would be entitled to subsistence allowance for herself and her dependent children, at the discretion of the Magistrate.

The Bill, brought by the Narendra Modi government aiming to criminalise instant divorce or talaq-e-biddat by men by uttering "talaq" thrice in quick succession, is now stalled in the parliament. All kinds of instant triple talaq - spoken, in writing or by electronic means, such email, text message or WhatsApp - would be illegal and void. "Our issue is with the criminalisation aspect". In a landmark 3-2 verdict, the apex court found the practice un-Islamic and "arbitrary", and disagreed that triple talaq was an integral part of religious practice. This was one of the demands made by the Opposition.
