The West Bengal State Election Commission had moved the SC challenging the ruling of the Calcutta HC division bench that ordered the commission to treat nominations filed through electronic messaging as legitimate.
That is why it has given an order asking the poll panel to accept nominations filed via email, " he said, referring to the court's recent order asking SEC to accept nominations of hundreds of candidates sent via email. "The court will hear the plea at 2:00 pm today", said Chief Justice of India (CJI) Dipak Misra.
Anticipating the move of the SEC, major state opposition, the CPI (M) and the BJP, have filed caveat before the top court saying that no ex-parte orders should be passed.
Dwivedi said that there is a procedure for further scrutiny of the nomination papers and objection raised by contesting candidates, but the High Court had directed the State Election Commission to straightway accept nominations filed through emails.
The SEC argued that the Calcutta High Court order violates its right to conduct the polls and decide on the process independently.
The court directed for the next hearing on 3 July.
